Terms of Service

These Terms of Service ("Terms") govern your access to and use of Cyvilo (the "Service"), operated by Xclusive Access LLC ("Cyvilo," "we," "us," or "our"). By creating an account, publishing a page, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account or publish a page on Cyvilo. By registering, you represent that you meet this requirement and that all information you provide is accurate.

2. What Cyvilo Is

Cyvilo lets creators build a single page — a photo, name, tagline, and a list of links — that visitors can use to find a creator's other profiles and destinations. Cyvilo hosts only the content you upload to your Cyvilo page directly (your photo, display name, tagline, and link labels); it does not host the content found at any destination your links point to.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access. Each creator may maintain one Cyvilo page.

4. Content Standards

Every photo, name, tagline, and link label published on Cyvilo must comply with our content standards. In short: your public Cyvilo page must remain safe-for-work. This means no explicit, sexually suggestive, or otherwise adult imagery or language anywhere on the page itself, regardless of what your linked destinations contain.

We enforce this automatically: photos are screened by an automated moderation system before publishing, and text (your display name, tagline, and link labels) is checked against a content filter. We may reject, remove, or unpublish content that violates these standards, with or without notice, and may suspend or terminate accounts for repeated or serious violations.

You are solely responsible for the content of the destinations your links point to, including ensuring that any such destination complies with applicable law and with the terms of service of any platform (such as a social media platform) where you share your Cyvilo page link.

5. Age-Gated Links

Cyvilo lets you mark a link as age-restricted ("18+"). When a visitor clicks an age-restricted link, we show them a confirmation screen asking them to confirm they are 18 or older before continuing to your linked destination.

This confirmation is a self-attestation, not independent age verification. We do not verify a visitor's age through any government ID, database check, or other independent means. You are responsible for understanding and complying with any age-verification or age-assurance laws that apply to you in the jurisdictions where your content or audience is located.

6. Subscriptions & Billing

Publishing a page requires an active paid subscription. Subscriptions are billed in advance on a recurring basis through our payment processor, Stripe, and automatically renew until cancelled. You can manage or cancel your subscription at any time from your dashboard. If your subscription lapses or payment fails, your page is automatically taken down (unpublished) until the subscription is reactivated — your page content and settings are preserved.

Except where required by law, payments are non-refundable, including for partial billing periods.

7. Custom Domains

If your plan includes custom domain support, you may connect a domain you already own, or purchase one through our domain marketplace integration. If you purchase a domain through Cyvilo, you — not Cyvilo — are the registrant of record; the domain remains yours if you cancel your Cyvilo subscription. You are responsible for your domain's registration fees, renewal, and compliance with your domain registrar's and registry's own terms.

8. Content You Provide; License to Us

You retain ownership of the photos and text you upload to Cyvilo. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content solely as necessary to operate and provide the Service to you and your page's visitors. You represent that you own or have the necessary rights to the content you upload.

9. Prohibited Uses

You agree not to use Cyvilo to:

• Upload or link to content involving minors in any sexualized context, non-consensual content, or any illegal content;
• Impersonate another person or misrepresent your affiliation with any person or entity;
• Attempt to circumvent, disable, or interfere with our content moderation, security, or rate-limiting systems;
• Use the Service in a way that violates any applicable law or the rights of a third party.

10. Third-Party Links & Sites

Cyvilo pages link out to third-party sites and services that we do not control and are not responsible for, including any content, products, or services offered there. Visiting a linked destination is at your own risk and subject to that destination's own terms and privacy practices.

11. Suspension & Termination

We may suspend or terminate your account or unpublish your page at any time, with or without notice, if we believe you have violated these Terms, applicable law, or if we determine it necessary to protect the Service or other users. You may stop using the Service and cancel your subscription at any time.

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that your page will avoid detection, flagging, or removal by any third-party platform (including social media platforms), and we make no guarantee about the outcome of using Cyvilo in connection with any other platform's policies.

13. Limitation of Liability

To the maximum extent permitted by law, Xclusive Access LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Service.

14. Indemnification

You agree to indemnify and hold Xclusive Access LLC harmless from any claims, damages, or expenses arising from your content, your use of the Service, or your violation of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the United States and the state in which Xclusive Access LLC is organized, without regard to conflict-of-law principles.
